Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and NomadLink ("we," "our," or "us") governing your access to and use of the DrawToLife mobile application and website (collectively, the "Service").

By downloading, installing, or using DrawToLife, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service. If you are accepting these Terms on behalf of a minor, you represent that you are the parent or legal guardian of that minor and accept these Terms on their behalf.

These Terms are supplemented by our Privacy Policy, which describes how we collect, use, and protect your information.

Description of Service

DrawToLife is a family-friendly mobile application that transforms children's drawings into styled digital artwork using artificial intelligence. The Service includes:

Image transformation using AI-powered style transfer (Photorealistic, Pixar 3D, Anime, Watercolor, Claymation)
Story creation from drawings with AI-generated narratives
Video generation via Movie Director mode
Character extraction and management
Achievement and collectible sticker systems
Daily creative challenges
Child profile management (up to 10 profiles per account)
Cloud sync for transformations, stories, and videos across devices

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

User Accounts

Account Creation

You may create an account using your email address or through third-party authentication (Google Sign-In or Apple Sign-In). You may also use the Service in Guest Mode via a device identifier without creating an account, subject to feature limitations.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activity that occurs under your account
You must provide accurate and complete information during registration
You must notify us immediately of any unauthorized use of your account
You may not transfer or share your account with others

Guest Mode

Guest Mode users access the Service via a device identifier. Guest data is stored locally and associated with that device. If you later create an account, your Guest Mode data will be migrated to your new account. Guest Mode may have limited features compared to registered accounts.

Children's Use & Parental Responsibility

DrawToLife is designed to be safe and enjoyable for children aged 4 and above when used under parental supervision. We are committed to complying with the Children's Online Privacy Protection Act (COPPA) and similar regulations.

Age Requirements

Users aged 13 and older may create and manage their own accounts
Children aged 4–12 may use the Service only under the supervision of a parent or legal guardian
Parents or legal guardians must create and manage accounts on behalf of children under 13

Parental Responsibilities

Parents and guardians are responsible for supervising their children's use of the Service
Parents manage child profiles and can view, edit, or delete their children's content at any time
Parents are responsible for any purchases made through their account, including those initiated by their children
If you become aware of any content or activity that concerns you, please contact us immediately

Child Safety Features

No social features, messaging, or communication between users
No advertising or behavioral tracking
No external links within the app
Content moderation to ensure child-appropriate outputs
Zero ads throughout the entire app

Subscriptions & Payments

Subscription Plans

DrawToLife offers the following subscription plans:

Monthly: $4.99/month, billed monthly
Annual: $34.99/year, billed annually
Lifetime: $79.99, one-time purchase

Billing and Renewal

All purchases and subscriptions are processed through the Apple App Store or Google Play Store
Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You may manage your subscription and turn off auto-renewal in your device's account settings

Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the free trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.

Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.

Credits & Virtual Currency

DrawToLife uses a credit-based system for AI-powered features such as image transformations, story generation, and video creation.

Credits are included with subscription plans and can also be purchased separately as credit packs
Credits are non-transferable and cannot be exchanged for cash or monetary value
Unused credits do not expire while your account remains active
Credits cannot be transferred between accounts
We reserve the right to modify credit pricing and allocation with reasonable notice
Upon account deletion, any remaining credits will be forfeited

User-Generated Content

Your Content

You retain ownership of the original drawings and images you upload to DrawToLife ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing the Service (e.g., generating transformations, stories, and videos).

Generated Content

Images, stories, and videos generated by the Service based on your User Content ("Generated Content") are provided for your personal, non-commercial use. You may save, share, and use Generated Content for personal purposes.

Content Guidelines

You must not upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
You must not upload content that infringes on the intellectual property rights of others
You must not attempt to generate inappropriate or harmful content through the Service
We reserve the right to remove any content that violates these guidelines without notice

Content Storage

User Content and Generated Content are stored locally on your device and synced to cloud storage for backup and cross-device access. We are not responsible for data loss resulting from device failure, app uninstallation, or other circumstances outside our control.

Intellectual Property

Our Intellectual Property

The Service, including its original content (excluding User Content and Generated Content), features, functionality, design, and underlying technology, is and will remain the exclusive property of NomadLink. The Service is protected by copyright, trademark, and other laws of Romania and international jurisdictions.

Trademarks

"DrawToLife," "NomadLink," and associated logos are trademarks of NomadLink. You may not use our trademarks without our prior written consent.

Feedback

If you provide us with suggestions, ideas, or other feedback regarding the Service, you grant us an unrestricted, perpetual, irrevocable, non-exclusive, royalty-free license to use such feedback for any purpose without compensation or attribution to you.

Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to reverse engineer, decompile, or disassemble the Service
Interfere with or disrupt the Service or servers or networks connected to the Service
Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
Use the Service to generate content that is illegal, harmful, or inappropriate for children
Use automated means (bots, scrapers, etc.) to access or interact with the Service
Circumvent or attempt to circumvent any security features, usage limits, or access controls
Sell, resell, or commercially exploit the Service or access to the Service
Impersonate any person or entity or misrepresent your affiliation with a person or entity
Use the Service in a way that could damage, disable, or impair its operation

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
The results obtained from the Service will be accurate or reliable
AI-generated content will meet your expectations or requirements
Any errors in the Service will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOMADLINK, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to defend, indemnify, and hold harmless NomadLink and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Any content you upload or submit through the Service

Termination

Termination by You

You may stop using the Service at any time. You may request account deletion through the app settings. Upon account deletion, your data will be permanently removed from our servers in accordance with our Privacy Policy.

Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms
Prohibited conduct
Fraudulent or illegal activity
Extended periods of inactivity

Effect of Termination

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability. Any unused credits or remaining subscription time will be forfeited upon termination for cause.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Iasi, Romania.

If you are a consumer in the European Economic Area, you may also have the right to bring proceedings in the courts of the member state in which you are domiciled.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

Posting the updated Terms within the app and on our website
Updating the "Last Updated" date at the top of this page
Sending an email notification for material changes

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
